iCoffee Terms of Service

1. Acceptance of Terms

Welcome to iCoffee. These Terms of Service ("Terms") govern your access to and use of the iCoffee mobile application (the "App"), website (icoffeeapp.com), and all related services (collectively, the "Service"). The Service is operated by iCoffee ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and iCoffee. We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

iCoffee is a coffee brewing companion application designed to help users improve their coffee brewing skills. The Service provides:

Brewing guidance and recommendations for various coffee preparation methods
Ability to log and track individual brews with associated scores and notes
AI-powered assistance and recommendations powered by Google Gemini
Management of favorite brewing methods, coffee beans, and equipment
Coffee preference profiling and personalized recommendations
Equipment registry including coffee machines with user manuals and instructions
Achievement tracking and brewing streaks
Photo uploads for brew documentation
URL safety checking for user-submitted manual links
Synchronization across multiple devices (for registered users)

The Service is provided "as is" and is intended as a tool to assist and enhance your coffee brewing experience. iCoffee makes no guarantees regarding the quality of coffee produced using our guidance, and brewing results may vary based on numerous factors outside our control.

3. User Accounts and Registration

3.1 Account Types

The Service offers two modes of access:

Guest Mode: Limited functionality without account creation
Registered Accounts: Full functionality with data synchronization and persistent storage

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. Providing false or misleading information may result in account termination.

3.5 Age Requirements

While the Service does not have a minimum age requirement, we do not knowingly collect information from children under 13. 4. User Content and Data

4.1 Your Content

You retain ownership of all content you create, upload, or submit through the Service, including but not limited to:

Brew logs, ratings, and tasting notes
Coffee bean information and reviews
Equipment details and preferences
Photos and media uploads
Profile information and preferences
AI chat interactions and prompts

4.2 Limited License to Your Content

By submitting content to the Service, you grant iCoffee a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display such content solely for the purposes of:

Operating, maintaining, and improving the Service
Providing personalized recommendations and AI-powered features
Generating aggregated, anonymized analytics and insights
Displaying your content to you across your devices

This license terminates when you delete your content or account, except for content that has been shared publicly (if applicable to future features) or incorporated into aggregated analytics.

4.3 Future Social Features

The Service may introduce features allowing users to share content publicly or with other users. When such features become available, additional terms and privacy controls will be provided.

4.4 User Responsibilities

You are solely responsible for your content and agree not to submit content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Infringes on intellectual property rights or other proprietary rights
Contains viruses, malware, or other harmful code
Violates any applicable laws or regulations
Impersonates any person or entity

5. Intellectual Property Rights

5.1 Ownership

The Service, including but not limited to its software, algorithms, source code, object code, design, structure, organization, user interface, graphics, logos, trademarks, trade names, domain names, content, features, and functionality, is owned exclusively by iCoffee and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

All rights not expressly granted to you in these Terms are reserved by iCoffee.

5.2 Trademarks

"iCoffee," the iCoffee logo, "Better Coffee Today," and all related names, logos, product and service names, designs, and slogans are trademarks of iCoffee. You may not use these marks without our prior written permission. Other names, logos, and brands referenced in the Service are the property of their respective owners.

5.3 Copyright

All content provided through the Service, including brewing guides, recommendations, instructional materials, and AI-generated responses, is protected by copyright and owned by or licensed to iCoffee.

5.4 Proprietary Information

The Service contains proprietary information, including but not limited to:

Brewing algorithms and recommendation engines
Data models and analytical methodologies
User interface designs and workflows
AI prompt engineering and response optimization techniques
Database structures and schemas
Business processes and operational methods

This information constitutes valuable trade secrets and confidential information of iCoffee.

6. Prohibited Uses and Restrictions

You agree NOT to:

6.1 Unauthorized Access and Interference

Access, tamper with, or use non-public areas of the Service or our systems
Probe, scan, or test the vulnerability of any system or network
Breach or circumvent any security or authentication measures
Access or search the Service by any means other than our publicly supported interfaces
Interfere with or disrupt the Service, servers, or networks connected to the Service
Use the Service in any manner that could disable, overburden, damage, or impair the Service

6.2 Reverse Engineering and Extraction

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or any component thereof
Copy, modify, create derivative works of, or attempt to extract any algorithms, methods, or techniques used in the Service
Use any automated tools, bots, scrapers, or data mining techniques to extract data from the Service
Attempt to recreate, duplicate, or clone the Service or any portion thereof
Analyze the Service's functionality to build a competitive or similar product or service

6.3 Misappropriation and Competition

Use the Service, its content, or any information obtained from it to develop, operate, or promote a competitive product or service
Use the Service's methodologies, techniques, or approaches for commercial purposes outside of personal coffee brewing improvement
Attempt to identify, derive, or reverse-engineer our proprietary algorithms, recommendation systems, or AI implementation strategies
Create products, services, or applications that compete with or substitute for the Service
Use insights, data, or methodologies from the Service to advise or assist competitors

6.4 Intellectual Property Violations

Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
Use our trademarks, trade names, service marks, logos, or branding without express written permission
Register domain names, social media handles, or business names confusingly similar to iCoffee or our marks
Create false association with iCoffee or misrepresent any affiliation with us
Claim ownership of or attempt to trademark any aspect of the Service

6.5 Misuse of Content and Features

Redistribute, sell, lease, sublicense, or otherwise transfer any content or functionality of the Service
Frame, mirror, or replicate any part of the Service on another website or platform
Use the Service for any illegal, fraudulent, or unauthorized purpose
Transmit spam, chain letters, or other unsolicited communications through the Service
Collect or harvest personal information of other users without their consent
Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

6.6 AI and System Abuse

Attempt to manipulate, exploit, or abuse the AI features for purposes other than personal coffee brewing assistance
Use the AI features to generate content that violates these Terms or applicable laws
Overload or abuse the AI service through excessive or automated requests
Attempt to extract, replicate, or reverse-engineer the AI prompt engineering or implementation
Use the Service's AI capabilities for any commercial application without authorization

6.7 Circumvention

Circumvent any technological measures we use to protect the Service
Bypass any access restrictions, usage limits, or payment requirements (when implemented)
Share account credentials or access with unauthorized parties
Use VPNs, proxies, or other methods to disguise your location or identity in violation of these Terms

Violation of any provision in this section may result in immediate termination of your account, legal action, and pursuit of all available remedies under applicable law.

7. AI-Generated Content and Disclaimers

7.1 AI Service Provider

The Service uses Google Gemini to power AI-assisted features, including brewing recommendations, conversational assistance, and personalized guidance. Your interactions with AI features are governed by both these Terms and Google's Terms of Service and Privacy Policy.

7.2 AI Content Disclaimer

AI-generated responses, recommendations, and guidance are provided for informational and educational purposes only. iCoffee makes no representations or warranties regarding:

The accuracy, completeness, or reliability of AI-generated content
The suitability of AI recommendations for your specific equipment, preferences, or circumstances
The consistency or reproducibility of AI-generated brewing advice
The quality or taste of coffee produced following AI guidance

7.3 No Professional Advice

AI-generated content does not constitute professional barista advice, food safety guidance, or any form of expert consultation. You should not rely solely on AI recommendations for critical decisions.

7.4 AI Limitations

AI responses may:

Contain errors, inaccuracies, or outdated information
Provide inconsistent recommendations across different interactions
Misinterpret your queries or context
Generate responses that do not align with your personal preferences or equipment capabilities

You acknowledge that AI is a tool to assist your coffee journey, not a replacement for personal experimentation and learning.

8. Coffee Brewing Disclaimers

8.1 No Guarantee of Results

IMPORTANT: iCoffee provides guidance and tools to assist with coffee brewing, but we make absolutely no guarantees regarding:

The quality, taste, or enjoyment of coffee produced using our recommendations
The achievement of specific flavor profiles or brewing outcomes
The consistency of results across different brewing sessions
The suitability of our guidance for your specific equipment, water quality, or coffee beans
The prevention of brewing errors or equipment damage

8.2 Variable Factors

Coffee brewing outcomes depend on numerous variables beyond our control, including but not limited to:

Coffee bean quality, origin, roast level, and freshness
Water quality, mineral content, and temperature
Equipment condition, calibration, and cleanliness
Environmental factors (temperature, humidity, altitude)
User technique, timing, and execution
Personal taste preferences and sensory perception

8.3 Equipment Use

You are solely responsible for the proper and safe use of your coffee brewing equipment. iCoffee is not responsible for:

Equipment malfunction, damage, or breakage
Burns, injuries, or property damage resulting from coffee brewing
Improper equipment use or maintenance
Equipment manufacturer defects or recalls

Always follow the manufacturer's instructions for your specific equipment. Our guidance is supplementary and does not replace manufacturer specifications or safety warnings.

8.4 User Manuals and Instructions

User manuals, equipment instructions, and other documents uploaded to or accessed through the Service are provided by users or third parties. iCoffee does not:

Verify the accuracy or completeness of such documents
Endorse specific equipment or manufacturers
Guarantee the safety or effectiveness of equipment or procedures described
Take responsibility for outdated or incorrect information in user-uploaded manuals

8.5 URL Safety Checks

While we use VirusTotal to check URLs submitted for manual extraction, we cannot guarantee:

The complete safety or legitimacy of any external website
The absence of malware, phishing, or malicious content
The accuracy of information on external sites
The continued safety of a URL after our initial check

You access external websites at your own risk.

8.6 Health and Safety

Coffee consumption and brewing may involve:

Hot liquids and equipment that can cause burns
Electrical equipment requiring proper handling
Caffeine and other substances that may affect health
Allergies or sensitivities to coffee or related products

Consult with a healthcare professional regarding caffeine consumption, especially if you have health conditions, are pregnant, or are sensitive to caffeine.

8.7 Personal Responsibility

You acknowledge that you are using iCoffee as a learning and tracking tool, and that ultimate responsibility for your coffee brewing results, safety, and satisfaction rests with you.

9. Third-Party Services and Content

9.1 Third-Party Integrations

The Service integrates with third-party services including:

Firebase (Authentication, Firestore, Storage, Analytics, Crashlytics)
Google AI (Gemini)
VirusTotal
Google Sign-In

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services or their availability, performance, or practices.

9.2 Third-Party Content

The Service may contain links to third-party websites, resources, or content. We do not endorse, control, or assume responsibility for any third-party content. Accessing third-party websites is at your own risk.

9.3 Changes to Third-Party Services

Third-party service providers may change, discontinue, or limit their services at any time, which may affect the Service's functionality. We are not liable for any such changes or their impact on your use of the Service.

10. Subscriptions and Payment Terms (Future)

10.1 Free Service

Currently, the Service is provided free of charge. We reserve the right to introduce paid features, subscriptions, or premium tiers in the future.

10.2 Future Subscription Model

When subscriptions are introduced:

Pricing and subscription terms will be clearly communicated
Existing users will receive advance notice before any paid features affect their current usage
Free features available at the time of subscription introduction may remain free or be grandfathered for existing users
Subscription terms, billing cycles, cancellation policies, and refund policies will be provided separately

10.3 Changes to Pricing

We reserve the right to modify pricing for subscriptions at any time. Existing subscribers will receive advance notice of price changes and the opportunity to cancel before new pricing takes effect.

10.4 No Obligation to Maintain Free Features

We reserve the right to modify, limit, or discontinue any free features at our discretion, though we will make reasonable efforts to communicate significant changes to users.

11. Data Privacy and Security

11.1 Privacy Policy

Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully.

11.2 Data Storage

Your data is stored using Firebase services (Firestore and Cloud Storage) and is subject to Google Cloud's security measures. Data is transmitted over HTTPS.

11.3 Data Synchronization

For registered users, your data is synchronized across devices. Guest mode data is stored locally on your device only.

11.4 Data Deletion

You may delete individual brews, beans, equipment entries, and photos within the App. You may delete your entire account and associated data through the App settings (My Profile → Delete account) or by contacting us at .icoffee.yourapp@gmail.com

Upon account deletion:

Your profile, logs, and related Firestore data will be removed
Your authentication account will be deleted
Aggregated analytics and crash data may persist for service improvement purposes
Local caches on your device will be cleared

11.5 Security Disclaimer

While we implement security measures including HTTPS encryption and Firebase security rules, no method of transmission or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

Deleting your account through the App (My Profile → Delete account)
Contacting us at icoffee.yourapp@gmail.com
Uninstalling the App (for guest users)

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service immediately, without notice, for any reason, including but not limited to:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Prolonged inactivity
Requests from law enforcement or government authorities
Technical or security issues
Discontinuation of the Service

12.3 Effect of Termination

Upon termination:

Your right to access and use the Service immediately ceases
We may delete your account data in accordance with our Privacy Policy and data retention practices
Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions

12.4 No Refunds

Upon termination for any reason, you will not be entitled to any refund of subscription fees or payments (when applicable).

13. Warranties and Disclaimers

13.1 AS-IS Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 No Warranty of Functionality

We do not warrant that:

The Service will meet your requirements or expectations
The Service will be available, uninterrupted, timely, secure, or error-free
Results obtained from the Service will be accurate, complete, or reliable
Any errors or defects in the Service will be corrected
The Service is free from viruses, malware, or other harmful components

13.3 Content Disclaimer

We do not warrant the accuracy, completeness, or usefulness of any content, recommendations, or information provided through the Service. Any reliance on such content is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ICOFFEE, ITS AFFILIATES, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
DAMAGES RESULTING FROM ANY USER CONTENT OR CONDUCT OF THIRD PARTIES
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
COFFEE BREWING RESULTS, QUALITY, OR OUTCOMES
EQUIPMENT DAMAGE, MALFUNCTION, OR INJURY

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

14.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR

14.3 Essential Purpose

You acknowledge that the limitations in this section reflect an allocation of risk and are a fundamental element of the basis of the bargain between you and iCoffee. The Service would not be provided without these limitations.

14.4 Jurisdictional Limitations

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless iCoffee, its affiliates, employees, agents, partners, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another party, including intellectual property rights
Your content or any content submitted through your account
Your violation of any applicable laws or regulations
Any coffee brewing accidents, injuries, or property damage
Any misrepresentation or breach of your obligations under these Terms

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

We reserve the right at any time to:

Modify, suspend, or discontinue the Service or any part thereof
Add or remove features, functionality, or content
Impose limits on certain features or access to the Service
Change the Service's technical requirements or compatibility

17. Geographic Scope and Governing Law

The Service is controlled and operated from the Netherlands. We make no representation that the Service is appropriate or available for use in all locations. Access to the Service from jurisdictions where its content or use is illegal is prohibited.

17.2 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

17.3 Jurisdiction

You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the courts of the Netherlands, and you consent to the personal jurisdiction of such courts.

You agree to comply with all applicable local, national, and international laws and regulations in your use of the Service.

18. Dispute Resolution

19. Miscellaneous Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iCoffee regarding the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of iCoffee.

19.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

19.5 Force Majeure

iCoffee shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, riots, natural disasters, pandemics, government actions, or failures of third-party services.

19.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated herein.

19.7 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

19.8 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

19.9 Electronic Communications

You consent to receive communications from us electronically, including via email or in-app notifications. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

19.10 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.

20. Open Source and Attributions

The Service may incorporate open-source software components. Such components are governed by their respective open-source licenses. Information about open-source components and their licenses may be provided in the App or upon request.

21. Export Control

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any government list of prohibited or restricted parties.

22. Beta Program

From time to time, we may offer beta programs for new features or versions of the Service. Participation is voluntary and subject to additional terms. Beta features may be unstable, incomplete, or modified without notice.

23. Feedback

We welcome your feedback, suggestions, and ideas about the Service. By providing feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, incorporate, and commercialize such feedback without any obligation to you.

The Service is a tool to assist your journey, not a guarantee of results
You are responsible for the safe use of coffee brewing equipment
iCoffee's intellectual property is protected and may not be copied or misused
Violations of these Terms may result in account termination and legal action
